Terms of service

These terms apply to all purchases made on alwayscat.ch. By placing an order, you accept them.
1. Who we are
alwayscat.ch is operated by Diamedia Sàrl, Ruelle de Borjaux 4, 1807 Blonay-Saint-Légier, Switzerland (UID CHE-361.087.115), “AlwaysCat”, “we”. Email: contact@diamedia.ch.
2. Products
We sell decorative resin cat sculptures, about 40 cm high, hand-painted and made to order, as well as e-gift cards. Because each sculpture is painted by hand, small variations in colour and detail from the photos are normal and are not a defect. Some photos are marked as digital previews: they show how a finish will look, not the exact piece you will receive. Our sculptures are decorative objects, not toys, and are intended for indoor use.
3. Orders and contract
Your order is an offer to buy. The contract is formed when we send the order confirmation email. We may refuse an order for a legitimate reason, for example an obvious pricing error, a suspected fraud or a delivery country we cannot serve. In that case, any payment is refunded in full.
4. Personalisation
For personalisable finishes, you can choose a short text of up to 15 characters (such as a name, a date or a short sweet word) and up to three small symbols, painted by hand on the cat's left haunch. We paint the text exactly as you enter it, so please check the spelling before ordering. We choose the paint colour and layout that read best on the finish. We may refuse or cancel, with a full refund, any personalisation that is offensive, unlawful or infringes the rights of others. Personalised sculptures are made to your specifications and are excluded from the right of withdrawal (see our Refund policy).
5. Prices
Prices are shown in the currency of your country or region and are fixed for your order at checkout. For deliveries in Switzerland, prices include Swiss VAT. For deliveries outside Switzerland, goods are exported from Switzerland; import duties, import taxes and customs fees of the destination country are not included and may be charged on delivery (see our Shipping policy). Shipping is free unless stated otherwise at checkout.
6. Payment
Payment is due when you order and is taken through the methods offered at checkout. Production starts once payment is received.
7. Production and delivery
Sculptures are made to order and leave our studio 4 to 6 weeks after your order is confirmed. Delivery times depend on the carrier and on customs. If we cannot meet the announced time, we will tell you and you may cancel for a full refund. Risk passes to you when the parcel is delivered to you or to the person you named.
8. Right of withdrawal and returns
You may withdraw from the purchase of a non-personalised sculpture within 14 days of delivery. The conditions, exceptions and a model withdrawal form are set out in our Refund policy.
9. Guarantee
We guarantee our sculptures for two years from delivery against manufacturing defects. If a defect appears, contact us with photos; we will repair, remake or refund the sculpture. Normal wear, accidental damage and damage caused by misuse, outdoor use or unsuitable cleaning products are not covered. Mandatory statutory rights in your country of residence are not affected.
10. E-gift cards
- E-gift cards are delivered by email and can be used for any purchase on alwayscat.ch, over one or several orders, until the balance is used up.
- They are valid for two years from the date of purchase. The expiry date is shown in the email that delivers the card.
- They are issued in Swiss francs. When used in another currency, the balance is converted at the exchange rate applied at checkout.
- They cannot be exchanged for cash, except where the law requires it, and cannot be used to buy other gift cards.
- Please keep your code safe: treat it like cash. We cannot replace a code that has been lost or used by someone else, unless the loss is our fault.
- An unused e-gift card can be refunded within 14 days of purchase.
11. Liability
We are liable for damage caused intentionally or through gross negligence, and for personal injury, as provided by law. Otherwise, to the extent permitted by law, our liability is limited to the price of the order concerned. This does not limit any mandatory consumer protection rights.
12. Intellectual property
The designs, photos, texts and the AlwaysCat brand are protected. Buying a sculpture does not give you the right to reproduce its design.
13. Personal data
We handle your data as described in our Privacy policy.
14. Changes
We may change these terms at any time. The version in force when you place your order applies to that order.
15. Applicable law and disputes
These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The courts at our registered office have jurisdiction. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence and may bring proceedings before the courts of that country. In case of a problem, please contact us first: we will always try to find a solution with you.
